Terms & Conditions

These Terms and Conditions (“Agreement”) govern the services provided by Obed Mwanza (“Photographer”, “we”, “us”) to the client (“Client”, “you”).


1. ServicesThe Photographer agrees to provide photography services as agreed upon (event, portrait, commercial, etc.), including the delivery of professionally edited images.


2. Booking and Payment

  • A non-refundable deposit of 30% is required to secure your booking and reserve your session date.

  • The remaining balance is due 14 days prior to the scheduled session or event date.

  • No services or final images will be delivered until full payment has been received.

3. Cancellation and Rescheduling

  • Client cancellations: the deposit is non-refundable.

  • Rescheduling may be permitted depending on availability.

  • Photographer cancellations: all payments received will be fully refunded.

4. Delivery of Photos

  • Delivery timeline: 2–4 weeks after the session or event.

  • Photos will be delivered through an online gallery.

  • The Photographer selects and edits images at their professional discretion.

5. Copyright and Usage

  • The Photographer retains full copyright of all images.

  • The Client receives a non-exclusive license for personal use.

  • Commercial use requires prior written permission from the Photographer.

6. Model Release and Image Use

  • The Client grants permission for images to be used for portfolio, website, and marketing purposes only if consent is given.

  • The Client may withdraw consent in writing, subject to reasonable limitations.

7. Client Responsibilities

  • The Client agrees to cooperate during the session.

  • For events, the Client is responsible for obtaining permission from attendees if required.

8. Limitation of Liability

  • The Photographer is not liable for circumstances beyond their control, including weather, venue restrictions, or unforeseen events.

  • In the event of technical failure or image loss, liability is limited to the total amount paid by the Client.

9. Force Majeure

The Photographer is not responsible for failure to perform due to events beyond reasonable control, including illness, natural disasters, or government restrictions.


10. Personal Information

Personal information is handled in accordance with our Privacy Policy and applicable Quebec laws.


11. Governing Law

This Agreement is governed by the laws of the Province of Quebec and the applicable federal laws of Canada.


12. Acceptance

By booking services, the Client confirms that they have read, understood, and agree to these Terms and Conditions.
